If you a.) become disabled during the term of this Contract and a physician confirms in writing to the Corporate Office that you are not physically able to use the facilities of the Company and that the disability will continue for more than 3 months, or b.) you are fearful that returning to the clubs may cause you to contract Covid-19, you are entitled to freeze the Contract for the duration of the disability. After you recover, you are entitled to an extension of the Contract for a period equal to the time of the disability. If you are permanently disabled, you may cancel the Contract and receive a pro rata refund of the amount paid pursuant to it. You agree to return your membership card in the event of permanent disability. Your membership must be paid up through the month of cancellation.

Cancel my membership
Our LVAC Membership Contract states: If Member permanently moves more than 20 miles one way from the club of enrollment and is unable to transfer this Contract to a comparable facility, Buyer shall be relieved from the obligations of making payments applicable to Member’s membership for services other than those received prior to notification of the move. To cancel a membership, Member’s contract must be paid up through the month of cancellation and Member must send to our office any two (2) of the following: as proof of Member’s new permanent residence: a current and valid lease, a utility bill, a bank statement or credit card bill, a yellow change of address label indicating mail was forwarded to Member’s new address by the post office, or Member’s new driver’s license with issue date. Member must also return Member’s membership card to the corporate office. Following cancellation, Member will be relieved from the obligation of making payment for services other than those received prior to cancellation and if you have prepaid for health club services, Member will receive a pro rata refund of the membership fee paid which are allocable to services which Member has not taken. All cancellations under this paragraph are subject to a $50.00 per person cancellation fee.
You may cancel this Contract if your club of enrollment permanently closes and you live more than 20 miles from any other club which you are entitled to use under the membership plan you have chosen or any substantially similar facility which will honor your membership at no additional charge for the remainder of your initial term or twenty-four months, if shorter. You will be required to adhere to the rules of any club which you transfer your membership. To cancel under this paragraph, your contract must be paid up through the month such club closes and return to our office your membership card and any other documents you receive at or after this Contract was signed evidencing membership in the health club. Your cancellation will be effective only when we receive all these items. Following cancellation, you will receive a pro rata refund of any membership fee paid in advance which are allocable to months after the club closing.

Settlement Offer
All our members’ needs are important to us as we face these unprecedented times, and LVAC is here to help. If you wish to cancel your membership and do not meet the above cancellation requirements, or you do not feel comfortable returning to the gym at this time, we are offering members a settlement of the remaining balance of the membership agreement.
